These Terms of Service (“Terms”) govern your access to and use of hostingitrust.com and the services provided by HostingITrust (a Ray Creations brand), including Managed WordPress Hosting, WordPress Maintenance & Care Plans, WordPress Consultation & One-Off Help, WordPress Speed Optimization, WordPress Security & Malware Cleanup, WordPress Backup & Recovery, and WordPress Site Migration (collectively, the “Services”).

By accessing our website, requesting a quote, purchasing a plan, or using our Services, you agree to these Terms.

If you do not agree, please do not use our website or Services.

1) Who we are and how to contact us

2) Definitions

  • “Client,” “you,” “your”: the person or entity purchasing or using our Services.
  • “We,” “us,” “our”: HostingITrust (Ray Creations brand).
  • “Website”: hostingitrust.com
  • “Content”: materials on our Website or provided to us for service delivery (including website files/databases you own).
  • “Client Site”: your WordPress site(s) we host, maintain, or support.
  • “Third-Party Services”: services not controlled by us (e.g., domain registrars, plugins, payment processors, email providers, CDNs).

3) Scope of Services

We provide WordPress-focused hosting and website services. Deliverables depend on the plan or project you purchase.

A) Managed WordPress Hosting

Hosting includes a WordPress-optimized environment and baseline operational management. Features may include caching, SSL support, monitoring, and server maintenance. Exact inclusions are described on our hosting pages and/or in your proposal or invoice.

B) WordPress Maintenance & Care Plans

Care Plans typically include scheduled updates, backups, security checks, monitoring, and limited support tasks per month, as described on the Care Plans page and your plan tier.

C) One-Off / Project Services

These include migrations, speed optimization, malware cleanup, backup setup and recovery, and consultations. These services are delivered based on the agreed scope, access provided, and the site’s technical realities.

D) No guarantee of specific results

We aim for strong outcomes, but we do not guarantee a specific PageSpeed score, ranking position, revenue increase, or security outcome. Results depend on many variables including hosting environment, plugins/themes, third-party scripts, traffic patterns, and existing code.

4) Client responsibilities

To provide Services efficiently and safely, you agree to:

  • Provide accurate information about your site, hosting, plugins/themes, and changes made.
  • Maintain valid and current contact details.
  • Provide required access (WordPress admin, hosting panel, SFTP, DNS/registrar, etc.) in a timely manner.
  • Ensure you have legal rights to all content, images, trademarks, and data on your site.
  • Keep your own copies of important content and data (even when backups are included).
  • Follow our guidance on security best practices (strong passwords, minimizing admin accounts, etc.).

You are responsible for your compliance obligations as a site owner (e.g., privacy notices, cookie consent, applicable industry regulations).

5) Access, credentials, and security

When you provide access for service delivery:

  • You grant us permission to access your systems solely for providing Services.
  • We recommend that you create temporary or role-limited accounts where possible.
  • You are responsible for maintaining the confidentiality of credentials you control.
  • If you believe credentials are compromised, notify us immediately.

We may refuse to proceed if the security risk is unreasonably high (e.g., illegal content, repeated unauthorized access, or unsafe configurations).

  • To deliver ongoing maintenance, backups, and support, we may create or maintain a dedicated administrator account on your WordPress site using our company email address. This access is used only to provide the Services.
  • Clients should not remove this account without coordinating, because it can break backups/monitoring.
  • Where applicable, we may install/connect a site-management plugin/tool to perform updates, monitoring, and backups (e.g., ManageWP Worker).

6) Backups and restores

Many plans include backup services; however:

  • Backup frequency and retention depend on the plan and the method used.
  • Backups may be performed and stored using third-party tools or infrastructure, depending on the plan and configuration.
  • Backups reduce risk but do not eliminate it. No backup system is perfect.
  • A restore may overwrite newer content, orders, or changes created after the restore point.
  • For high-change sites (e.g., WooCommerce), we may coordinate timing to reduce data loss risk, but you accept that some data loss may be unavoidable in emergency restores.

Where backup setup is purchased as a one-off service, ongoing backup reliability may depend on the underlying third-party tools and hosting environment.

7) Security and malware

We take security seriously, but:

  • No provider can guarantee a website will never be hacked.
  • Malware cleanup can be complex. In some cases, a full rebuild or migration may be required if the hosting environment or codebase is severely compromised.
  • We may recommend removing outdated or unsupported plugins/themes that create serious security risk.

If your site is actively harmful (e.g., distributing malware), we may suspend or restrict services until it is addressed.

8) Third-party services and plugins

Your site may rely on third-party tools (plugins, themes, analytics, payment gateways, email services, CDN, domain registrars). Examples may include site management/backup services (e.g., ManageWP), CDNs, and security tools, each subject to their own terms/policies. You acknowledge:

  • Third-party outages, updates, policy changes, or vulnerabilities can affect your site.
  • We are not responsible for third-party failures beyond our control.
  • Some work may require paid licenses for plugins/tools (you are responsible for those costs unless explicitly included in your plan).

9) Content ownership and licenses

You retain ownership of your site content and intellectual property.

By providing content and access, you grant us a limited right to use it solely for:

  • Delivering Services
  • Troubleshooting, optimizing, and maintaining your site
  • Creating backups, staging copies, or test environments as needed

10) Acceptable use

You agree not to use our hosting or Services to:

  • Distribute malware, spyware, or engage in hacking
  • Host illegal content
  • Send spam or facilitate abusive traffic
  • Infringe intellectual property rights
  • Attempt unauthorized access to our systems or other clients’ sites

We may suspend or terminate Services if we believe your use violates these Terms or creates risk to our infrastructure or other clients.

11) Fees, billing, and payments

A) Pricing and invoices

Prices are shown on our site or provided via quote/invoice. Some projects may require a fixed quote after assessment.

B) Payment method

At present, we may request payment using PayPal payment links or other agreed methods. Payment instructions will be provided by email or invoice.

C) Late payments

If payment is overdue, we may pause work, suspend services, or delay renewals until the account is brought current.

D) Taxes

You are responsible for any taxes, duties, or fees applicable in your jurisdiction unless otherwise stated on the invoice.

12) Renewals, cancellations, and refunds

A) Subscriptions (hosting and care plans)

  • Plans typically renew monthly or annually depending on your billing choice.
  • You may cancel by emailing [email protected] with reasonable notice before renewal.
  • If you cancel, service may continue until the end of the paid billing period unless otherwise agreed.

B) One-off services

One-off services are generally non-refundable once work has started, because time and resources are allocated.

C) Refunds

Refunds, if any, are handled case-by-case. We aim to be fair. In general:

  • If no work has started and no access has been used, a refund may be possible.
  • If work has started, refunds may be partial or not available depending on progress.

D) Migrations and cutover timing

For migrations, DNS propagation and third-party factors may affect timing. If a project is delayed due to missing access or client-side delays, we may reschedule.

13) Support and communication

We provide support via email and other channels as agreed.

Response times depend on your plan level and our current workload. Where “priority” is described, it generally means we handle those requests before non-priority queues, especially for emergencies (site down, security issues).


14) Service limitations

We may refuse or pause Services if:

  • Required access is not provided
  • The site is unsafe, illegal, or abusive
  • The site is unstable due to third-party conflicts beyond reasonable scope
  • The work requested goes beyond the plan’s included tasks (we can offer a separate quote)

15) Disclaimers

To the fullest extent permitted by law:

  • The Website and Services are provided “as is” and “as available.”
  • We do not guarantee uninterrupted service, error-free operation, or that all vulnerabilities can be eliminated.
  • You remain responsible for business decisions and compliance obligations tied to your website.

16) Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, business interruption).
  • Our total liability for any claim related to the Services will not exceed the amount you paid us for the specific service giving rise to the claim in the three (3) months immediately preceding the event, or USD $500, whichever is lower (unless a higher cap is required by applicable law).

17) Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from:

  • Your content and your site’s data collection practices
  • Your breach of these Terms
  • Illegal or infringing content on your site
  • Misuse of Services

18) Privacy

Our Privacy Policy explains how we handle personal information. By using our Services, you also agree to our Privacy Policy.

19) Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Website or Services after changes means you accept the updated Terms.

20) Governing law and dispute resolution

These Terms are governed by the laws applicable in India, without regard to conflict of law principles.

If a dispute arises, we will try to resolve it amicably first. If not resolved, you agree that courts in Noida / Uttar Pradesh, India will have jurisdiction, unless mandatory local consumer laws require otherwise.

21) Entire agreement

These Terms, along with our Privacy Policy and any written proposal/invoice/statement of work you accept, form the entire agreement between you and HostingITrust regarding the Services.
